INYOI PURCHASE POLICY

1. Introduction

INYOI, in collaboration with Ticketbeep Inc. and NYXELLAPP, S.L., is dedicated to the commercialization and sale of tickets for concerts, festivals, and tours in the entertainment sector. Sales are made both from our own website and from the event’s website, implementing our software through a white label. By purchasing tickets through INYOI, you agree to the terms and conditions described in this Purchase Policy.

2. General Terms

2.1. Acceptance of Terms and Conditions: The purchase of tickets through INYOI is subject to availability and acceptance by the user of these terms and conditions.

2.2. Prices: All ticket prices are indicated in the corresponding currency and may be subject to additional charges, such as service fees and commissions. Prices may vary according to the event organizer’s policy and ticket demand.

2.3. Price Changes: INYOI reserves the right to modify ticket prices at any time before completing your purchase. Modifications will not affect purchases that have already been made and confirmed.

2.4. Purchase Limits: Ticket sales are limited to a specific number per event and per person. This amount may be modified at INYOI’s discretion to prevent unauthorized resales.

2.5. Availability: INYOI does not guarantee that all tickets you request will be available. Tickets may be sold out or unavailable for other reasons.

2.6. Sales Restrictions: The purchase of tickets for events is intended for end consumers only. Purchasing tickets for commercial purposes or resale without express authorization from INYOI and/or the event organizer is prohibited.

3. Purchase Procedure

3.1. Registration and Account: To purchase tickets, you must create an account on our website or access it through the event’s website, providing the required information, including your name, email address, and payment details.

3.2. Purchase Confirmation: The purchase is considered complete when you have received a confirmation email with the details of your purchase. This email will serve as your purchase receipt and should be kept for future reference.

3.3. Buyer Information: You agree to provide truthful and updated information during the purchase process. INYOI is not responsible for tickets not received due to incorrect information provided by the user.

3.4. Communications: By completing the purchase, you agree that INYOI may send you communications related to your purchase, including confirmations, reminders, and any other relevant information.

4. Payment Methods

4.1. Payment Acceptance: We accept various payment methods, including credit and debit cards, as well as other authorized payment methods like electronic payments and bank transfers.

4.2. Immediate Payment: All payments must be made at the time of purchase. No ticket will be processed until full payment has been received.

4.3. Payment Processing: Charges on your credit or debit card will be processed through our secure payment system. We use encryption technologies to ensure the security of your payment data.

4.4. Payment Rejection: In the event that payment is rejected for any reason, your purchase will not be completed, and the tickets will not be reserved. INYOI is not responsible for payment rejections that are the responsibility of your bank or payment service provider.

4.5. Additional Charges: INYOI is not responsible for additional charges that your bank may apply for international transactions or currency exchange. It is your responsibility to check with your bank for any additional charges.

5. Ticket Delivery

5.1. Delivery Methods: Tickets may be delivered electronically or physically, depending on the type of event and the option selected during the purchase process. Electronic tickets may include QR codes, barcodes, or download links.

5.2. User Responsibility: It is your responsibility to ensure that you have received the tickets and that all the information on them is correct. If you detect any errors, you should contact INYOI customer service as soon as possible.

5.3. Physical Delivery: If you choose the physical delivery option, the tickets will be sent to the address provided during the purchase process. INYOI is not responsible for tickets lost or stolen after they have been sent.

5.4. Electronic Tickets: For electronic tickets, you must present a valid QR code or barcode at the event entry point. Duplication or falsification of electronic tickets is prohibited and may result in their cancellation without a refund.

5.5. Non-receipt of Tickets: If you have not received your tickets within the specified time, you must contact INYOI customer service as soon as possible. INYOI will strive to resolve any delivery issues in a timely manner.

6. Use of Tickets

6.1. Personal and Non-transferable: Tickets are personal and non-transferable, except with the express authorization of the event organizer. Transferring tickets to third parties without the consent of INYOI and/or the event organizer is not allowed.

6.2. Resale Prohibition: Reselling or transferring tickets for commercial purposes without authorization is prohibited. Unauthorized resale of tickets may result in their cancellation without a refund.

6.3. Fraudulent Use: Any attempt to fraudulently use the tickets will result in their immediate cancellation without a refund. INYOI reserves the right to take legal action against any person involved in fraudulent activities.

6.4. Identification at the Event: You must present valid identification along with your ticket at the event entry point if required by the event organizer. Lack of valid identification may result in denied access to the event without a refund.

6.5. Event Conditions: The ticket grants you the right to attend the event under the conditions established by the event organizer. Failure to comply with these conditions may result in expulsion from the event without a refund. It is your responsibility to familiarize yourself with the event’s rules and policies before attending.

7. Cancellation and Changes Policy

7.1. Final Sales: All ticket sales are final, and no changes or refunds are allowed, except in cases provided for in the refund clause.

7.2. Purchase Errors: In the event of errors in the purchase of tickets, you should contact INYOI customer service as soon as possible. INYOI will strive to correct any error but does not guarantee that errors can be corrected after purchase.

7.3. Cancellation by INYOI: INYOI reserves the right to cancel a ticket purchase in case of suspected fraud, violation of these terms and conditions, or any other justified reason. In the event of cancellation by INYOI, you will be notified, and the total amount of the tickets will be refunded.

8. Refund Clause: Return Policy in Case of Date Changes or Cancellations

8.1. General Rule: As a general rule, once a ticket has been purchased, it cannot be returned, although some exceptions are provided for in this clause.

8.2. Event Modifications: If the event organizer significantly modifies any of the essential conditions of the event (date, location, etc.), your tickets will remain valid without the need for any additional action. However, if you wish, you may opt to request a refund of your tickets through the means and within the timeframes established by the event organizer.

8.3. Capacity Reduction: Exceptions to the previous paragraph include cases where, due to regulatory or authority restrictions or for any other justified reason, the event’s maximum capacity is reduced. In this case, the event organizer may cancel your ticket, and you will have the right to an automatic refund, similar to what happens in cases of event cancellation by the organizer.

8.4. Event Cancellation: In the event that the organizer cancels the event, you will automatically be entitled to a refund of your tickets, which will be refunded using the same payment method indicated at the time of purchase.

8.5. Refund Procedure:

  1. The event organizer is responsible for authorizing refunds, not INYOI. INYOI is not responsible for the refund but acts as a mere intermediary between the event organizer and the user, so it will only proceed with the refund once the organizer has authorized the return and transferred the corresponding amount to INYOI.
  2. If, after requesting a refund from the event organizer, the organizer has not offered a satisfactory alternative or authorized the refund within thirty (30) days, we recommend that you contact the consumer protection authority in your place of residence.
  3. In no case will the amount paid for INYOI’s service fees be refunded, as INYOI’s intermediary services are considered effectively provided once you purchase your ticket.

9. Liability

9.1. Limitation of Liability: INYOI is not responsible for any damage, loss, or expense (including loss of enjoyment) resulting from any cancellation, change, or any other incident related to the event.

9.2. Event Guarantees: INYOI does not guarantee that events will be held as advertised and is not responsible for the performance of the artists, event duration, sound quality, stage visibility, among other aspects related to the event.

9.3. Damage and Losses: INYOI is not responsible for losses or damages suffered during the event, including damage to personal property or personal injury. It is your responsibility to take necessary precautions to protect your belongings and personal safety during the event.

10. Changes to the Purchase Policy

10.1. Right to Modification: INYOI reserves the right to modify these policies at any time. Modifications will be effective upon their publication on our website. It is your responsibility to regularly review our website to stay informed of any changes to the policies.

10.2. Notification of Changes: In case of significant changes to the purchase policies, INYOI will make reasonable efforts to notify you via email or a prominent notice on our website.

16. Security Measures and Conduct at the Event

16.1. Instructions and Security Measures: By attending the event, you agree to follow all instructions and security measures established by the event organizer and competent authorities. This may include, but is not limited to, social distancing measures, mask-wearing, temperature checks, and other health and safety protocols.

16.2. Disruptive Behavior: Failure to comply with security measures or disruptive behavior may result in expulsion from the event without a refund. The event organizer and security personnel have the authority to expel anyone who does not comply with the event’s policies.

16.3. Prohibited Items: Some events may have restrictions on items that can be brought to the venue. This may include, but is not limited to, prohibitions on external food and beverages, professional cameras, weapons, drugs, and other prohibited items. It is your responsibility to review the event’s policies and ensure compliance with all restrictions.

17. Force Majeure Events

17.1. Definition of Force Majeure: INYOI will not be responsible for the failure to comply with these purchase policies due to force majeure events, including but not limited to natural disasters, armed conflicts, pandemics, strikes, or any other event beyond our reasonable control.

17.2. Notification and Alternative Options: In the event of a force majeure event, INYOI will make every effort to notify you as soon as possible and provide alternative options, including the possibility of rescheduling the event or refunding the ticket amount, subject to the event organizer’s authorization.
